NICS Background Check — 2026
How the Firearms Background Check Works
Every firearm purchase from a licensed dealer (FFL) in the United States requires a background check through the National Instant Criminal Background Check System (NICS), administered by the FBI. The process is fast, federally mandated, and applies regardless of which state you’re in or what type of firearm you’re buying. Here’s everything you need to know.
The Basic Process
1) Fill out ATF Form 4473 at the dealer. 2) Dealer calls FBI NICS or uses electronic system. 3) FBI checks federal and state criminal databases. 4) Response: Proceed (approved), Denied, or Delayed (more time needed). 5) If Proceed: complete purchase. If Denied: no sale, you can appeal. If Delayed: dealer waits up to 3 business days.

Private Sales & GunTransfer.com
Background Checks for Private Sales
Federal law does not require background checks for private party sales between unlicensed individuals. However, individual states vary significantly — some require all sales to go through an FFL with a background check; others have no such requirement.
This is where GunTransfer.com provides critical value: a documented background check, bill of sale, and lifetime digital records for $50 flat — making any private sale legal and documented in all 50 states, regardless of state requirements. Both parties are protected.

FAQs
Background Check FAQs
How long does a NICS background check take?
Most NICS checks complete in seconds. About 8% result in a ‘Delay’ where the dealer must wait up to 3 business days. If not resolved in 3 days, the dealer may (but is not required to) proceed with the sale. About 1% are denied.
Can I appeal a denied background check?
Yes — NICS provides a denial appeal process through the FBI. You can also request a Voluntary Appeal File (VAF) to expedite future purchases. Contact a firearms attorney for help — many denials are due to data errors.
Do background checks prevent crimes?
FBI NICS has denied over 400,000 attempted purchases since 1998. However, most criminals acquire firearms through theft, straw purchases, and unregulated transfers — not licensed dealers. The effectiveness of background checks is a legitimate policy debate.
What happens to the Form 4473?
Form 4473 is retained by the FFL dealer for 20 years (or until they go out of business, when records transfer to ATF). It is NOT entered into a national registry — it exists only to investigate crimes by tracing firearms back to first sale.
